AI Scaler Trial 使用許諾 / Terms of License

お客様は、アストロデザイン株式会社（以下「弊社」という）が定めるAI Scaler Trial使用許諾（以下「本規約」という）に基づき、AI Scaler Trialを使用するものとします。なお、AI Scaler Trialをインストールしたとき、お客様は本規約に同意したものとみなします。
You shall be bound by this AI Scaler Trial Terms of License (hereinafter referred to as the “Terms”) provided by ASTRODESIGN,Inc. (“Company”) when using AI Scaler Trial. Further, you shall be deemed to have agreed to this Terms when you install AI Scaler Trial.

第１条（使用許諾）/ Article 1. LICENSE GRANT

1. 弊社は、お客様にAI Scaler Trialを１ライセンス付与し、お客様が１台のコンピュータに1回に限りインストールして使用することを許諾します。
   The Company grants you a license to install one copy of AI Scaler Trial on one computer device for your use.
2. お客様はAI Scaler Trialをインストールしてから30日間に限り使用することができます。
   You will be able to use AI Scaler Trial for 30 days after your installment.

第２条（権利の帰属）/ Article 2. NO OTHER RIGHTS

AI Scaler Trialの著作権その他の権利は、弊社に帰属します。お客様は本規約によって許諾されている以外のAI Scaler Trialに関するいかなる権利を取得することはできません。
ALL copyrights and other proprietary rights to AI Scaler Trial shall belong to the Company. You may not obtain any rights to AI Scaler Trial except for the license expressly granted in this Terms.

第３条（禁止事項）/ Article 3. PROHIBITIONS

弊社は、お客様が次の各号に掲げる事項を行うことを禁止します。
The Company prohibits you to do any of the followings:

1. AI Scaler Trialの複製すること
   To make a copy of AI Scaler Trial;
2. 逆コンパイル・逆アセンブル・リバースエンジニアリングその他の方法により、AI Scaler Trialのソースコードを追跡すること
   To de-compile, de-assemble, reverse engineer or use any other means to track the source code of AI Scaler Trial;
3. AI Scaler Trialの全部又は一部の改変、再配布・再使用許諾・公衆送信（送信可能化を含む）、AI Scaler Trialの貸与・譲渡すること
   To make modification to all or in part of, to re-distribute, to sub-license, to transmit publicly (including, to make it transmittable), or to lend or transfer AI Scaler Trial;
4. ネットワーク経由でAI Scaler Trialを使用させること、又はAI Scaler Trialの機能を利用した処理・サービスをネットワーク経由で提供すること
   To enable the use of AI Scaler Trial through networks, or provide process or services through networks using AI Scaler Trial functions;
5. 複数のコンピュータを同時に使用又は共有可能なシステムでAI Scaler Trialを使用すること
   To use AI Scaler Trial with multiple computer devices simultaneously or with sharable system;
6. AI Scaler Trialを第三者に使用させること
   To have a third party use AI Scaler Trial; or
7. 権利保護を目的としてAI Scaler Trialにあらかじめ設定された技術的な制限を解除・無効化する行為、当該行為の方法の公開、又は前記方法を用いてAI Scaler Trialを複製、改変、使用すること
   To remove or disable the technical restrictions set by the Company on AI Scaler Trial for the purpose of its right protections, to publish the methods of such removal or disabling, or to copy/alter/use AI Scaler Trial by such methods.

第４条（保証）/ Article 4. NO WARRANTY

弊社は、AI Scaler Trialを現状有姿のまま提供します。弊社は、AI Scaler Trialの操作が停止せずエラーがないこと、AI Scaler Trialの欠陥が弊社によって修正されることなど、いかなる明示的または黙示的な保証も致しません。
Company provides AI Scaler Trial AS IS. Company makes no warranty, whether expressed or implied, that AI Scaler Trial will not stop operating nor has any error, or that Company will correct any defect of AI Scaler Trial.

第５条（責任の制限）/ Article 5. LIMITATION OF LIABILITY

1. 弊社は、AI Scaler Trialの使用又は使用不能から生じたお客様の損害に対し、一切責任を負いません。
   Company shall not be liable for any loss or damages borne by you due to the use or out of use of AI Scaler Trial.
2. お客様が期待する成果を得るためのAI Scaler Trialの選択、導入、使用および使用結果につきましてはお客様の責任とさせていただきます。
   You shall be liable for choosing, installing, using AI Scaler Trial and the result thereof to meet your expectations.

第６条（契約解除）/ Article 6. TERMINATION

1. 次の各号のいずれかに該当したとき、弊社は本規約を解除し、AI Scaler Trialの使用を終了させることができます。
   In the event you meet any of the followings, Company may terminate the Terms and have you stop using AI Scaler Trial.
   1. お客様が本規約のいずれかの条項に違反したとき
      You have breached any of the Terms;
   2. お客様がAI Scaler Trialの著作権を侵害したとき
      You have infringed any of the copyright to AI Scaler Trial.
2. 第１項により本規約が終了した場合、お客様は自己の負担でAI Scaler Trialを、弊社の指示に従い、直ちに返却又は破棄するものとします。
   When the Terms is terminated due to the above section, you shall, at your own cost and expense, return or dispose of AI Scaler upon Company’s instruction.

第７条（一般条項）/ Article 7. MISCELLENEOUS

1. AI Scaler Trialは事前の予告なしに改訂することがあります。
   AI Scaler Trial may be modified without prior notice.
2. 本規約は日本法に準拠するものとし、本規約に関する紛争は東京地方裁判所を第一審の専属的行為管轄裁判所とします。
   The Terms shall be governed by the Laws of Japan, and any disputes related to this Terms shall be submitted to its exclusive jurisdiction of Tokyo District Court of Japan.
3. お客様は、AI Scaler Trialの使用にあたり、著作権法、輸出規制関連法を含む法令を遵守するものとします。
   You shall observe and comply with all laws and regulations, including copyright law and export regulations, when using AI Scaler Trial.
4. 本規約は、日本語を正文とします。本約款の参考として英語による翻訳文が作成される場合においても、日本語の正文のみが効力を有するものとし、英語訳にはかかる効力がないものとします。
   The official text of this Terms is provided in Japanese. Notwithstanding any English translation of the Terms provided as a reference, the Japanese version shall be valid, and the English version shall have no effect to this Terms.
